These terms govern your use of Coxsmart.com and all Coxsmart products, apps, and services.

1 Who We Are

Coxsmart is a health technology company offering smart wearable devices — including smart rings and health monitoring accessories — and the associated Coxsmart mobile application.

Coxsmart sells products through coxsmart.com and de.coxsmart.com, hosted on the Shopify platform. When you purchase from us, you contract with Coxsmart under these Terms of Service.

2 Accepting These Terms

By accessing or using Coxsmart's website, app, or any Coxsmart product, you agree to be bound by these Terms of Service.

By placing an order, you confirm that:

  • You are at least the age of majority in your country of residence, or you have obtained parental or guardian consent
  • All information you provide to us is accurate and complete
  • You will use our products and services lawfully and in accordance with these terms
Health device disclaimer Coxsmart products are consumer wellness devices designed for informational and reference purposes. They are not medical devices and are not intended to diagnose, treat, cure, or prevent any medical condition. Always consult a qualified healthcare professional for medical advice.

3 Your Account

To use certain features — including the Coxsmart app, health data tracking, and family sharing — you may need to create an account.

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these terms or applicable law.

Family Sharing If you use Family Sharing to monitor the health data of another person (e.g., a parent or child), you confirm that you have their consent to do so, and that all data shared is processed in accordance with our Privacy Policy.

4 Purchasing Products

All orders are subject to availability and confirmation of the order price. We make every effort to display accurate product information, including colors, specifications, and pricing.

Please note:

  • Product images are for illustrative purposes. Actual colors may vary slightly due to monitor settings.
  • We reserve the right to refuse or cancel any order, including orders that appear to be placed by resellers or in violation of our policies.
  • Prices are listed in USD and are subject to change. Discounts and promotional pricing are applied at checkout using valid codes.

Payment

We accept PayPal, Visa, Mastercard, American Express, and Apple Pay. All payments are processed securely via Shopify Payments.

Shipping

Orders ship within 24 hours on business days. Shipping times vary by destination. See our Shipping Policy for details.

For returns and exchanges, please review our Return Policy. EU consumers also have additional rights under Section 5 below.

5 Your Right to Withdraw (EU & UK)

EU & UK Consumer Rights If you reside in the European Union or the United Kingdom, you have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you (or a third party nominated by you, other than the carrier) receive the goods.

How to exercise your right of withdrawal:

To meet the withdrawal deadline, you must send your clear statement of withdrawal before the 14-day period has expired. You may use the model withdrawal form below, or contact us at hello@coxsmart.com.

Model Withdrawal Form "I hereby withdraw from the contract for the purchase of the following goods: [PRODUCT NAME], Order number: [ORDER NUMBER]. I received the goods on [DATE]. Name: [YOUR NAME]. Address: [YOUR ADDRESS]. Signature (if submitted on paper): [SIGNATURE]."

Effects of withdrawal:

If you withdraw, we will reimburse all payments received from you, including the cost of standard delivery (but not express or expedited shipping surcharges). We will process the reimbursement within 14 days of receiving your withdrawal notice, using the same payment method you used for the original transaction unless otherwise agreed.

You must return the goods to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal. You are responsible for the direct cost of returning the goods unless we have agreed otherwise.

Exceptions: The right of withdrawal does not apply to sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.

6 Health Data & Privacy

Your privacy matters to us. Coxsmart products collect health-related data — including heart rate, SpO2, HRV, and sleep information — through sensors in your smart ring and the Coxsmart app.

Your Data Is Yours

Your health data belongs to you. We do not sell your personal or health data to third parties.

GDPR Compliance

For EU residents, we process your data in accordance with the General Data Protection Regulation (GDPR).

Data Storage

Data is stored on secure servers with encryption. You may request access to, correction of, or deletion of your data at any time.

Health Integrations

With your consent, you may connect Coxsmart to Apple Health, Google Fit, and Samsung Health.

For full details, please read our Privacy Policy. For EU/UK residents, this includes your rights under GDPR — including the right to access, rectify, erase, restrict processing, object to processing, and data portability.

Right to Erasure ("Right to be Forgotten") Under GDPR, you have the right to request the deletion of your personal data. To exercise this right, contact us at hello@coxsmart.com  We will process your request within 30 days, subject to any legal retention obligations.

7 Your Content

You retain ownership of any content you submit to Coxsmart — including reviews, photos, comments, and health data. By submitting content, you grant us a limited license to use, display, and distribute it in connection with our services.

You agree that your content will not:

  • Violate any third-party rights, including copyright, trademark, or privacy rights
  • Contain defamatory, abusive, obscene, or unlawful material
  • Introduce viruses, malware, or other harmful code

We reserve the right to remove content that violates these terms, at our discretion, without prior notice.

8 Prohibited Uses

You may not use Coxsmart's website, products, or services:

  • For any unlawful purpose or in violation of applicable laws
  • To infringe upon or violate the intellectual property rights of Coxsmart or any third party
  • To harass, abuse, defame, or harm any person
  • To submit false, misleading, or fraudulent information
  • To transmit harmful code, viruses, or malicious content
  • To collect or harvest the data of other users without their consent
  • To spam, phish, or engage in any form of automated abuse
  • To reverse engineer, disassemble, or attempt to extract the proprietary technology of Coxsmart products

Violation of any of these terms may result in immediate suspension or termination of your account and access to our services.

9 Third-Party Services

Coxsmart products and apps may integrate with third-party services, including:

  • Apple Health, Google Fit, Samsung Health, and other health platforms
  • Bluetooth-enabled devices and wireless networks
  • Third-party apps you link to your Coxsmart account

These third-party services are governed by their own terms and privacy policies. We are not responsible for the practices or content of any third-party service.

App Store & Google Play If you downloaded the Coxsmart app from the Apple App Store or Google Play Store, you may also be subject to the respective platform's terms of service and policies.

10 Intellectual Property

All content on Coxsmart's website — including text, graphics, logos, images, product designs, and software — is the property of Coxsmart or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

Coxsmart's trade names, trademarks, product names, and logos (including "Coxsmart," "CX18," and related branding) may not be used without prior written consent.

You may not copy, reproduce, distribute, or create derivative works from our content without permission, nor reverse engineer Coxsmart products or software.

11 Warranties & Disclaimers

Coxsmart products are covered by a limited warranty against manufacturing defects for a period of 12 months from the date of original purchase. This warranty covers defects in materials and workmanship under normal use. It does not cover:

  • Damage caused by misuse, accident, or unauthorized modifications
  • Normal wear and tear (including scratches, fading, or cosmetic damage)
  • Damage caused by exposure to water beyond the rated depth (5ATM)
  • Products purchased from unauthorized resellers

To make a warranty claim, please contact us at hello@coxsmart.com with your order number and a description of the issue.

They are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Health data provided by Coxsmart products is for informational purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment.

EXCEPT AS EXPRESSLY STATED HEREIN, COXSMART PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12 Limitation of Liability

To the maximum extent permitted by applicable law, Coxsmart and its affiliates shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities
  • Any damages arising from reliance on health data provided by Coxsmart products
  • Any damages resulting from use of Coxsmart products beyond their intended scope
  • Any inaccuracies in health data due to sensor limitations, user error, or environmental factors

In no event shall Coxsmart's total cumulative liability exceed the amount you paid for the product or service giving rise to the claim.

Consumer Rights Some jurisdictions do not allow the exclusion or limitation of certain liabilities. If you are an EU consumer, your statutory rights under applicable consumer protection law are not affected by this section. For UK consumers, your rights under the Consumer Rights Act 2015 remain fully valid.

13 Indemnification

You agree to indemnify, defend, and hold harmless Coxsmart, VEEKOO TECHNOLOGY LIMITED, and our affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your breach of these Terms of Service
  • Your misuse of Coxsmart products or services
  • Your violation of any applicable law or third-party rights
  • Any content you submit through our services

14 Governing Law & Dispute Resolution

For EU Consumers

These terms are governed by the laws of the country in which you reside. Disputes are subject to the non-exclusive jurisdiction of the courts of your country of residence.

For UK Consumers

These terms are governed by the laws of England and Wales. Disputes are subject to the courts of England and Wales, without prejudice to your statutory rights as a consumer.

For All Other Users

These terms are governed by the laws of Hong Kong SAR. Disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.

Online Dispute Resolution

The EU's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.

Consumer Protection Nothing in these terms affects your statutory rights as a consumer under applicable law. If you believe your consumer rights have been violated, you may file a complaint with your local consumer protection authority.

15 Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our products, services, legal requirements, or business practices. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page
  • Post the revised version on our website
  • Notify you via email or app notification for significant changes (e.g., changes affecting your rights or data processing)

Your continued use of Coxsmart products and services after any changes constitutes acceptance of the updated terms. If you do not agree to the changes, you may stop using our services and close your account.
